テロリストを特定・統制する拡大方策に関する決議

安全保障理事会は、

　1999年10月15日付決議第1267号・2000年12月19日付決議第1333号・2001年7月30日付決議第1363号・2001年9月28日付決議第1373号・2002年1月16日付決議第1390号・2002年12月20日付決議第1452号・2003年1月17日付決議第1455号・2004年1月30日付決議第1526号・2004年10月8日付決議第1566号・2005年7月29日付決議第1617号・2005年9月14日付決議第1624号・2006年8月8日付決議第1699号並びに関連する議長声明を想起し、
　いかなる形態のいかなる示威のテロリズムも平和と安全に対する最も深刻な脅威であり、テロリズムのいかなる行為もその動機や時期・対象にかかわらず犯罪であり正当化できないことを再確認し、無辜の市民の犠牲者及びその他の犠牲者を生み、財産を破壊し、大きく安定尾を揺るがすことを企図した複数の犯罪的テロ行為を継続しているアルカイダ・オサマ＝ビン＝ラディン・タリバンその他これらと関係する個人・集団・企業・組織に対し明確な非難を繰り返し強調し、
　タリバン及びアルカイダその他これらを関連する個人・集団・企業・組織によるアフガニスタンにおける暴力・テロ活動の増加に深い懸念を表明し、
　国際連合憲章及び国際法に従い、テロ行為により引き起こされた国際平和と安全に対する脅威とあらゆる手段を講じて戦う必要性を再確認し、この観点からこの努力の主導・調整において国際連合が果たす重要な役割を強調し、
　テロリズムは、テロリストの脅威を防止し、弱体化させ、孤立化させ、無能力にするためにあらゆる国家・国際機関・地域機関による積極的な参加及び協力を含む継続的かつ包括的なアプローチによってのみ打ち勝つことができることを強調し、
　決議第1267号（1999）に基づき設置された委員会（以下「委員会」と記す）及び加盟国の間の対話がこれらの措置の全面的履行に不可欠であることを強調し、
　委員会と加盟国との最も対話の最も効果的な手段の１つは現地への訪問を含む直接的な接触であることを認識し、
　国際刑事警察機構＝国際連合安全保障理事会特別連絡体制（the Interpol-United Nations Security Council Special Notices）の創設及び決議第1699号（2006）の一節を含む国際刑事警察機構（Interpol）との協力拡大を歓迎し、アルカイダ・オサマ＝ビン＝ラディン・タリバンその他これらと関係のある個人・集団・企業・組織への対策の履行を強化するために加盟国が国際刑事警察機構及び国際機関・地域機関との枠組みにおいて活動することを奨励し、
　テロリストの活動と戦うための重要な手段として本決議第1パラグラフにおける措置の断固とした履行の必要性に留意し、
　下記第1パラグラフにおいて言及される措置は事実上予防的措置であって、国内法で設定された犯罪の基準に依存するものではないことを繰り返し強調し、
　決議第1617号（2005）第1パラグラフ及びその他の関連する決議における措置を遂行するにあたり、決議第1452号（2002）第1・第2パラグラフにおける免除に関する条項について条項の詳細規則への留意を強調し、
　本決議第1パラグラフ(c)における措置の履行に際し各国を支援する有益な手段となることを意図した武器禁輸に関する委員会文書 SCA/2/06(20) に留意し、
　テロ行為を促進する、アルカイダ・オサマ＝ビン＝ラディン・タリバンその他これらと関係のある個人・集団・企業・組織によるインターネットの犯罪への悪用に対する深い懸念を表明し、
　特にテロリストのイデオロギーにおいて高められた、アルカイダ・オサマ＝ビン＝ラディン・タリバンその他これらと関係のある個人・集団・企業・組織により示された脅威の性質の変化に懸念をもって留意し、
　アルカイダ・オサマ＝ビン＝ラディン・タリバンその他これらと関係のある個人・集団・企業・組織がさらした国際平和と安全に対する脅威のあらゆる局面に関する会議の重要性を強調し、
　国際連合憲章第7章の下に行動し、

措置

1. あらゆる国家は決議第1267号（1999）・第1333号（2000）に基づき作成されたリスト（「一覧表（Consolidated List）」と記す）に言及されたアルカイダ・オサマ＝ビン＝ラディン・タリバンその他これらと関係のある個人・集団・企業・組織に関し、決議第1267号（1999）第4パラグラフ(b)・決議第1333号（2000）第8パラグラフ(c)・決議第1390号（2002）第1・第2パラグラフにより既に導入された措置を講じるべきことを決定する。
   
   1. 彼らまたは彼らのために彼らの指示で直接または間接に所有または管理している財産から派生する財源を含み、これらの個人・組織・企業・団体の財源及び金融資産または経済資源を遅滞なく凍結し、そのような個人の便益のために彼らの同胞または彼らのいる領土内のいかなる個人によって直接または間接に金融資産または経済資源を入手可能な状況におかせない。
   2. 本パラグラフにいかなる国に対しても入国拒否または国外退去を強制する記述がなく、かつ、入国または通過が司法手続きの履行に必要な場合には本パラグラフは適用すべきでなく、または、決議第1267号（1999）に従い設置された委員会（以下「委員会」と記す）が入国または通過が妥当であると個別に判断する場合にはそのような個人の属する領土への入国または通過を防止する。
   3. これらの個人・組織・企業・団体に対する、彼らの国内外からの直接または間接の供給・販売・譲渡またはあらゆる種類の船舶または航空機の使用、兵器・弾薬・軍用車両・軍装備・準軍事的装備及び上述のものの予備部品を含む武器及び関連物資並びに軍事活動に関連する技術的助言・支援・訓練を防止する。
2. 本決議第1パラグラフ(a)に基づく口座その他の金融資産または経済的資源の遅滞なき凍結の義務を各国に想起させる。
3. 本決議第1パラグラフ(a)における要請はあらゆる種類の経済的資源に適用されることを確認する。
4. 各国に対し本決議第1パラグラフ(b)及び(c)における措置を履行するための努力を強化することを要請する。

一覧表への掲載

5. 一覧表への掲載を提案された場合には、各国は決議第1526号（2004）第17パラグラフ及び決議第1617号（2005）第4パラグラフに従い行動し、申立書（statement of case）を提出すること、その申立書には(i)その個人または組織が上記の問題に適合していることを決定することを支援する情報、(ii)情報の性質、(iii)提供された情報または文書の支援に関して可能な限り詳細に記載されるべきこと並びに各国は提案された被指名人と現在一覧表に掲載されている個人または組織との関係に関する詳細を含むべきであることを決定する。
6. 指名する国には、提出の際に一覧表に掲載されている個人または組織を通知する目的で公開される申立書の部分を特定し、それらの部分は関係諸国からの要請で公開することを要請する。
7. 各国に対し一覧表への掲載を提案された場合には掲載要請の透明性と一貫性を確保するために付属文書I（Annex I）に添付されたカバーシート（cover sheet）を用いることを要請する。
8. 委員会に対し、一覧表に掲載されるべき者の加盟国からの提出の奨励を指示する。
9. 委員会に対し、一覧表に掲載されている個人及び組織に関する、利用可能となった凍結資産・それらの個人の移動に関する情報の更新を含む追加情報の提出を各国に奨励することを指示する。
10. 事務局は、一覧表に名称が追加されてから２週間以内に公表した後に、個人または組織が在籍すると思われる国の常任ミッション（the Permanent Mission）に、個人の場合にはその個人の国籍を保有する国に（この情報の範囲は既知）に通知すべきであり、この通知に公的に公開可能な部分の複写、関連する決議及び一覧表からの削除要請を検討するにあたっての委員会手続き、決議第1452号（2002）において提供された指定の効果の記述を含むことを決定する。
11. 第10パラグラフにある通知を受領した各国に対し、国内法及び慣習に従い一覧表に記載された個人または組織に指定されたことを通知するために適切な措置を講じること並びにこの通知に公的に公開可能な部分の複写、関連する決議及び一覧表からの削除要請を検討するにあたっての委員会手続き、決議第1452号（2002）において提供された指定の効果の記述を含むことを要請する。
12. 各国に対し、決議第1617号（2005）第2パラグラフにおいて記載されたように、アフガニスタン産の麻薬及びその前駆物質の違法栽培・生産・取引から派生する収益に限らずあらゆる手段を通じ、一覧表に掲載すべきアルカイダ・オサマ＝ビン＝ラディン・タリバンその他これらと関係のある個人・集団・企業・組織の活動・支援・財政援助に参加した個人及び組織の名称を委員会に提出することを奨励する。

一覧表からの削除

13. 委員会は一覧表に掲載されている個人及び組織の一覧表からの削除に関するガイドラインを作成し、採択し、適用すべきであることを決定する。
14. 一覧表から名称を削除するか否かを決定するにあたり、委員会は他の項目ともども (i)個人または組織が特定の手違いのために一覧表に掲載されているか否かまたは (ii)関連する決議、特に決議第1617号（2005）において設定された条件にもはや適合していないと見なせるか否かを検討すること、並びに、上記(ii)の評価にあたり委員会が他の項目ともども whether その個人が故人となっているかか否かまたは個人または組織が決議第1617号（2005）において定義された、一覧表に掲載されているあらゆる個人及び組織を含むアルカイダ・オサマ＝ビン＝ラディン・タリバン及びその支援者とあらゆる関係を閉ざしていることが明らかにされているか否かを検討することを決定する。

免除（Exemptions）

15. 決議第1452号（2002）第1パラグラフ(a)に従い通知される委員会による検討の期間を48時間から3作業日まで延長することを決定する。
16. 委員会は基本的支出のために必要と各国に通知することにより決定された口座及びその他の金融資産または経済的資源の凍結解除を防ぐために、決議第1452号（2002）第1パラグラフ(a)に従う通知に関する否定的な決定を行わねばならないことを繰り返し強調する。
17. 委員会に対し決議第1452号（2002）第1パラグラフ(a)の条項に関連したガイドラインを上記第15パラグラフに記したように見直すことを指示する。
18. 各国に対し、決議第1452号（2002）第1パラグラフ(b)に従い、口座がテロリズムに資金を与えるために用いられることを防ぐ観点から、そのような口座の利用に関する適時な委員会への報告を奨励する。

措置の履行

19. 各国に対し、本決議第1パラグラフに記述された措置のあらゆる局面の全面的履行のために適切な手続きを特定し、必要に応じて導入することを奨励する。
20. 本決議第1パラグラフ(a)により導入された措置は、アルカイダ・オサマ＝ビン＝ラディン・タリバンその他これらと関係のある個人・集団・企業・組織を支援するために利用されるインターネットホスティングまたは関連サービスに用いられたものに限らずあらゆる形態の金融資産に適用されることを強調する。
21. 委員会に対し、上記第1パラグラフに基づく措置に従わない危険性を特定することを指示し、委員長に対し、下記第31パラグラフに従い安全保障理事会への定期報告においてこの問題に関する委員会の活動についての進展報告を行うことを要請する。
22. 各国に対し一覧表の最新版は関連する政府機関及びその他の機関、特に資産凍結及び国境警備を担当する機関が迅速に入手できるよう保証することを要請する。
23. 事務総長に対し、委員会にその委任活動内容を履行するためによりよい手段を提供し、本決議第1パラグラフにおいて言及された措置を履行するためのよりよい手段を加盟国に提供するために国際連合及びInterpol・ICAO・IATA・WCOを含む関連する国際機関・地域機関の間の協力の拡大のために必要な措置を講じることを要請する。

タリバン

24. 各国に対し、一覧表に記載されるべき、タリバンに現在関係している個人及び組織の名称を委員会に対し提出することを奨励する。
25. 委員会に対し、一覧表に記載されたタリバンに属する個人及び組織を特定する情報及び他の情報を追加することを各国に奨励するよう指示する。
26. Directs 委員会に対し、 ガイドラインに従い活動し、タリバンに関係する個人及び組織の名称を一覧表に記載する要請に関する検討を行い、タリバンの関係者として掲載された者で、もはやタリバンと関係しない者を一覧表から削除する要請の検討を行うことを指示する。

協力

27. 委員会・テロ対策委員会（CTC; the Counter Terrorism Committee）・決議第1540号（2004）に基づき設置された委員会並びにそれぞれの専門家グループの間の、情報共有・各国への合同訪問・技術的支援・これら３委員会に関連する他の問題への対処を含む、緊密な協力及び情報の交換の継続の必要性を繰り返し強調する。

努力（Outreach）

28. 委員会が制裁措置の効果的な履行に関して加盟国との間の口頭及び／または書面の連絡によるフォローアップを行うことの重要性を繰り返し強調する。
29. 加盟国に対し、関連する問題の徹底した討議のために委員会に資する代表を派遣することを強く奨励する。
30. 委員会に対し、本決議及び決議第1267号（1999）・第1333号（2000）・第1390号（2002）・第1455号（2003）・第1526号（2004）・第1617号（2005）の全面的履行を各国に奨励する観点から、上記第1パラグラフにおいて言及された措置の全面的・効果的履行を拡大するために委員長及び／または委員による、適切な時期・適切な場所を選出した国への訪問を検討することを要請する。
31. 委員会に対し、委員会及び解析支援監視チーム（Analytical Support and Sanctions Monitoring Team ；「監視チーム（Monitoring Team）」と記す）の活動全般に関し、少なくとも180日ごとに委員長を通じて口頭で、必要であればあらゆる関連する加盟国に対する説明を含むCTC及び決議第1540号（2004）に基づき設置された委員会委員長による報告とあわせて、安全保障理事会に報告することを要請する。

監視チーム及びレビュー

32. 決議第1617号（2005）第20パラグラフに基づき事務総長により任命されたニューヨークに拠点を置く監視チームの現在の活動委任期限を、その任務遂行において委員会を支援するために、付属文書II（Annex II）において概括された責務を持った委員会の指示の下、さらに18か月の延長を決定し、事務総長に対しこの努力のために必要な調整を行うことを要請する。
33. 本決議第1パラグラフに記述された措置は、そのさらなる強化の観点から、18か月以内に、必要であればその期限よりも早期に見直すことを決定する。
34. この問題に引き続き積極的に取り組むことを決定する。

Resolution Annex II

In accordance with paragraph 32 of this resolution, the Monitoring Team shall operate under the direction of the Committee established pursuant to resolution 1267 (1999) and shall have the following responsibilities:

1. To collate, assess, monitor and report on and make recommendations regarding implementation of the measures, including implementation of the measures in paragraph 1(a) of this resolution as it pertains to preventing the criminal misuse of the Internet by Al-Qaida, Osama bin Laden, the Taliban, and other individuals, groups, undertakings, and entities associated with them, to pursue case studies, as appropriate; and to explore in depth any other relevant issues as directed by the Committee;
2. To submit a comprehensive program of work to the Committee for its review and approval, as necessary, in which the Monitoring Team should detail the activities, envisaged in order to fulfil its responsibilities, including proposed travel, based on close coordination with the CTC's Executive Directorate ("CTED") and the 1540 Committee's group of experts to avoid duplication and reinforce synergies;
3. To submit, in writing, two comprehensive, independent reports to the Committee, one by 30 September 2007 and the other by 31 March 2008, on implementation by States of the measures referred to in paragraph 1 of this resolution, including specific recommendations for improved implementation of the measures and possible new measures;
4. To analyze reports submitted pursuant to paragraph 6 of resolution 1455 (2003), the checklists submitted pursuant to paragraph 10 of resolution 1617 (2005), and other information submitted by Member States to the Committee as instructed by the Committee;
5. To work closely and share information with CTED and the 1540 Committee's group of experts to identify areas of convergence and overlap and to help facilitate concrete coordination, including in the area of reporting, among the three Committees;
6. To assist the Committee with its analysis of non-compliance with the measures referred to in paragraph 1 of this resolution by collating information collected from Member States and submitting case studies, both on its own initiative and upon the Committee's request, to the Committee for its review;
7. To present to the Committee recommendations, which could be used by Member States to assist them with the implementation of the measures referred to in paragraph 1 of this resolution and in preparing proposed additions to the Consolidated List;
8. To consult with Member States in advance of travel to selected Member States, based on its program of work as approved by the Committee;
9. To encourage Member States to submit names and additional identifying information for inclusion on the Consolidated List, as instructed by the Committee;
10. To study and report to the Committee on the changing nature of the threat of Al-Qaida and the Taliban and the best measures to confront it, including by developing a dialogue with relevant scholars and academic bodies, in consultation with the Committee;
11. To consult with Member States and other relevant organizations, including regular dialogue with representatives in New York and in capitals, taking into account their comments, especially regarding any issues that might be contained in the Monitoring Team's reports referred to in paragraph c of this annex;
12. To consult with Member States' intelligence and security services, including through regional fora, in order to facilitate the sharing of information and to strengthen enforcement of the measures;
13. To consult with relevant representatives of the private sector, including financial institutions, to learn about the practical implementation of the assets freeze and to develop recommendations for the strengthening of that measure;
14. To work with relevant international and regional organizations in order to promote awareness of, and compliance with, the measures;
15. To assist other subsidiary bodies of the Security Council, and their expert panels, upon request with enhancing their cooperation with Interpol, referred to in resolution 1699 (2006);
